Service Seniority (CML) Fixation Rule :
TAMIL NADU STATE AND SUBORDINATE SERVICES RULES
(Corrected up to 23rd July, 2009)
Page No : 24 Rule 4 e
*{ (e) If an approved candidate selected by the Tamil Nadu Public Service Commission for
appointment by direct recruitment fails to join duty ordinarily within three months from the date of
receipt of the orders directing him to join duty or with in an earlier date, if so specified by the
appointing authority in special circumstances, he shall forfeit his right for appointment to the post and
his name shall be removed from the approved list;
Provided that in special circumstances the appointing authority may extend the time limit
referred to in this sub-rule up to six months for valid reasons.}

#(Provided further that in very special circumstances and in relaxation of the above proviso,
if any candidate is allowed to join duty beyond the time limit of six months, his seniority in that post
shall be fixed below the junior most candidate appointed to that post in that service on the date of
joining duty of the former.)

Tngda state secretary k.senthil selected in 1989 tnpsc in my batch with cml 6073/2005, joined only on 24/11/1993. his cml no is above many joined between 1989 to 1993.
THE G.O WHICH SAYS THAT IF NOT JOINED SERVICE WITHIN 6 MONTHS OF APPOINTMENT EVEN IN SPECIAL CIRCUMSTANCES LIKE UNDERGOING A PG COURSE IS NOT AT ALL ACCEPTABLE.
IF IMPLEMENTED MANY WILL BE AFFECTED INCLUDING DME,DMS,HODs and PROFESSORS.
IF AFFECTED PERSONS GO TO COURT THE ENTIRE PROCESS OF PROMOTION BASED ON GO dated 23.10.09 will come to a standstill.
NEARLY 300 DOCTORS SELECTED BY TNPSC 1989 WERE DOING PG COURSE AT THE TIME OF APPOINTMENT AND HENCE COULDNOT JOIN SERVICE IMMEDIATELY.
IF DISTURBED IN CML EVEN WITH THIS GENUINE REASON, WE WILL BE FORCED TO GO TO COURT OF LAW TO GET JUSTICE
Few of our members, who are placed by mistake in CML 2005 and 2009 before doctors joined in service before them threatening now, that, they will go to court to get justice, and this will lead to standstill of promotion process as per G.O. 354. Court is to upheld rules and give relief to affected persons and not to legalize mistake.Whenever a mistake is detected, it is to be rectified.If mistake are accepted as uncorrectable ,then there is no meaning in legal proceeding and appeal.
As per state service rule, maximum time allowed to join service without loosing TNPSC seniority is SIX moths. As per central service rules, maximum time allowed to join service without loosing UPSC seniority is NINE moths.This is in force for many years.
Service rule can not be overruled to benefit few doctors who are enjoying benefit by mistake what they are not eligible legally. So CML anomalies is to be rectifid to give relief to the affected doctors.
DELAY IS BETTER THAN NEVER.
even the new cml list is not an updated one. Many doctors' (who are now in DME side from DPH side,) cml no. is not updated, if at all it is done their station is not updated.
state secretary is requested to clarify the following.associate professor promotion counselling is keeping on postponed.we want to know whether the promotion order will be antedated because of refitment.already many doctors [nonclinical side] have crossed 5 years teaching experience.if not those with 13-14 years service are losers because of refitment as we neither fall in pay band 4 norgetting the regular promotion
what happened to the court case in 4e rule in cml fixation anomaly ; what is the final judgement
